Welcome to Napkin Note, owned and operated by Yaiks Incorporated (“we,” “our,” “us”). These Terms & Conditions (“Terms”) govern your use of Napkin Note (the “App”). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, you may not use the App.
1. Purpose of the App
Napkin Note provides affirmations and mindset tools to support personal well-being. It is intended for informational and self-improvement purposes only. It is not medical, psychological, or therapeutic advice.
2. Eligibility
You must be at least 12 years old to use Napkin Note.
If you are between 12–18 years old, you must have consent from a parent or legal guardian.
By using the App, you confirm that you meet these requirements.
4. User Content
You may create and store custom affirmations or notes in the App (“User Content”).
You retain ownership of your User Content.
By using the App, you grant us a limited license to store and display User Content solely for the operation of the App.
You agree not to upload content that is unlawful, harmful, abusive, defamatory, obscene, or otherwise inappropriate.
User Responsibility for Content: You are solely responsible for any content you upload, submit, or create within Napkin Note (“User Content”). By providing User Content, you represent and warrant that you have all necessary rights, licenses, and permissions to use and share such content, and that your User Content does not infringe or violate the rights of any third party, including intellectual property rights, privacy rights, or contractual rights.
Yaiks Incorporated does not monitor or pre-screen User Content and assumes no responsibility or liability for it. If any claim, dispute, or legal action arises from your User Content, you agree to hold Yaiks Incorporated harmless and to fully indemnify and defend Yaiks Incorporated (including its officers, directors, employees, and affiliates) from any damages, losses, costs, or expenses (including reasonable attorneys’ fees) resulting from such User Content.
5. Prohibited Uses
You agree not to:
Use the App for illegal purposes.
Reverse-engineer, decompile, or attempt to access the App’s source code.
Interfere with the security, availability, or proper functioning of the App.
Use the App for advertising, spam, or commercial solicitation without permission.
No Automated Scraping or AI Training: You may not use any automated system, including (without limitation) bots, crawlers, spiders, or scrapers, to access the App, website, or related services for any purpose without our prior written consent. In particular, you are prohibited from collecting, copying, or using any content, data, or user information from Napkin Note for the purpose of developing, training, or improving artificial intelligence (AI) or machine learning models, whether for commercial or non-commercial purposes.
6. Intellectual Property
All content, trademarks, and materials within Napkin Note (other than User Content) are the property of Yaiks Incorporated.
You may not copy, modify, distribute, or create derivative works without our prior written consent.
7. Payment & Subscriptions
Napkin Note may offer free and paid features.
Subscription fees (if applicable) will be clearly displayed in the App or App Store listing.
Payments are processed through Apple App Store or Google Play.
All fees are non-refundable except where required by law.
8. Disclaimer of Warranties
Napkin Note is provided on an “as is” and “as available” basis.
We make no warranties regarding the effectiveness, reliability, or results of using the App.
Napkin Note is not a substitute for professional medical or psychological treatment. If you have mental health concerns, consult a licensed professional.
9. Limitation of Liability
To the maximum extent permitted by law:
Yaiks Incorporated is not liable for any damages arising from your use of the App.
This includes (but is not limited to) loss of data, personal injury, or emotional distress.
